冷血殺2命 最高法院4度撤銷死刑

三峽恩主公醫院停車場雙屍命案，歷審5次將凶手沈文賓判死，最高法院為此召開生死辯時，檢方痛斥沈男犯行殘忍，讓死者家屬「淚已乾、夜不能眠」應判死，但法官仍以原判決有四項程序瑕疵為由，昨4度撤銷沈文賓的死刑，連同其弟沈文夏被判無期徒刑部分發回更審，被外界質疑法官就是不願判死刑。
2012年12月10日沈文賓夥同胞弟沈文夏，持槍到宜蘭冬山鄉一處檳榔攤，押走可能知道妻子下落的檳榔攤老板潘孟瑤及其友人呂俊偉，他殘暴地將2人扔進路旁水溝，溺斃後載到三峽恩主公醫院停車場棄屍，一審到高院更三審均判他死刑。
最高法院上月進行辯論，沈的律師辯稱，沈男不小心殺死2名被害人後，緊急送往醫院想要救治，並非最嚴重的犯行，沈遭收押在看守所後為死者立牌位，每天唸經迴向給死者，並非沒有悔意，請求法官撤銷死刑發回更審。
最高法院審理後仍認為更三審判決有四項缺失，首先是去年3月首次開庭後，5月再開庭卻沒有更新審判程序，審判長沒有要求檢辯再次陳述上訴要旨，也沒有再調查證據，直接命辯論終結且逕行判決。
其次，沈文賓兄弟各判處死刑及無期徒刑，但量刑的資料包含新北市社會局的個案處理報告、賠償被害人家屬資料及台大精神鑑定報告，都沒有讓沈男及其律師表示意見。
由審判長林勤純、主辦法官林立華、法官黃斯偉、鄧振球、莊松泉組成的合議庭，更指責判死的依據與卷內資料不符，且起訴書未援引剝奪他人行動自由法條，審判沒有說明理由，認為這些違誤影響事實的確定，將全案撤銷發回更審。
